			<content:encoded><![CDATA[<p></p><p>According to the state of New Jersey&#8217;s website, the most scientific measure of identifying whether a driver is under the influence of alcohol is through blood alcohol concentration (BAC). Typically, law enforcement will test BAC through either a sobriety or breathalyzer test.</p>
<p>Under New Jersey law, when a person with a BAC of 0.08% or greater operates a motor vehicle, they are considered to be driving under the influence of alcohol (DUI).</p>
